These Terms of Service ("Terms") govern your access to and use of buildcrate.co and the BuildCrate product (the "Service"), operated by BuildCrate ("we", "us", "our"). By creating an account or paying for a subscription you agree to these Terms.
1. The Service
BuildCrate is a software-as-a-service toolkit providing AI-assisted research, brand and operations tools for ecommerce operators. The Service is sold as a subscription at the price displayed at checkout, currently AUD $39 per month for founding members (price locked while subscription is continuous).
2. Eligibility & accounts
- You must be at least 18 years old and able to form a binding contract.
- You must provide accurate registration information and keep it current.
- You are responsible for safeguarding your password and all activity under your account.
- Accounts are for a single individual. Sharing logins is prohibited; we enforce a 2-device session limit.
- Notify us immediately at team@buildcrate.co of any unauthorised use.
3. Subscription, billing & cancellation
- Subscriptions auto-renew monthly until you cancel.
- Cancellation is one-click from the Settings → Manage billing portal (Stripe). Cancellation takes effect at the end of the current billing period; no further charges are taken.
- All prices are in AUD and are inclusive of GST where applicable.
- Failed payments may result in suspension of access after a 7-day grace period.
4. Refunds
Refunds are governed by our Refund Policy, which forms part of these Terms.
5. Acceptable use
You agree not to:
- Reverse-engineer, scrape, or resell the Service.
- Share your login or use the Service on behalf of multiple businesses on one seat.
- Upload unlawful, infringing, harmful, defamatory or misleading content.
- Use the Service to send spam, run phishing, build weapons, or violate any law.
- Probe, scan or test the vulnerability of our systems without prior written consent.
- Use AI features to produce content that infringes third-party rights or violates the underlying model providers' policies.
We may suspend or terminate accounts that breach this section.
6. Intellectual property
- Our IP: the Service, including software, design, copy, frameworks, prompts and aggregated intelligence (Weekly Drops, Niche Radar, Supplier Vault entries) is owned by BuildCrate and protected by copyright. You receive a personal, non-exclusive, non-transferable licence to use it during your subscription.
- Your content: you retain ownership of the brand briefs, notes and inputs you create. You grant us a limited licence to host, process and display that content solely to provide the Service to you.
- AI output: outputs generated by AI features are provided as-is; you are responsible for reviewing them before use and for ensuring they do not infringe third-party rights.
7. Confidentiality of intel
Member-only content (Drops, Vault, Niche Radar) is licensed for your internal use only. You may not republish, resell, or share it outside your business. Breach is grounds for immediate termination without refund.
8. Disclaimers
The Service is provided "as is" and "as available". We do not warrant uninterrupted operation, accuracy of AI outputs, or that the Service will produce any particular business result. Nothing in BuildCrate constitutes financial, legal or tax advice.
No earnings guarantee. BuildCrate is a software toolkit, not a get-rich-quick program. Any revenue figures, case studies, screenshots, or examples referenced on this site or inside the product are illustrative only and are not a promise or projection of results. Your results depend on your effort, market, product, execution and many factors outside our control. Most people who start an online business do not become profitable.
Third-party trademarks. BuildCrate is an independent product. We are not affiliated with, endorsed by, or sponsored by Shopify Inc., Meta Platforms, Inc. (Facebook, Instagram), TikTok, Google LLC, Stripe, or any other third-party platform we reference or integrate with. Shopify is a trademark of Shopify Inc. Meta, Facebook and Instagram are trademarks of Meta Platforms, Inc. All other trademarks are property of their respective owners and are used for descriptive purposes only.
AI outputs. Tools inside BuildCrate use large language models. Outputs can be wrong, incomplete, or out of date. You are responsible for reviewing AI output before acting on it, including any marketing copy you publish or financial decisions you make based on it.
Affiliate disclosure. Some outbound links (including the Shopify partner offer) are affiliate links. We may earn a commission at no extra cost to you if you sign up through them. This does not influence our product recommendations.
9. Limitation of liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, including lost profits or revenue.
Nothing in these Terms excludes or limits any rights you have under the Australian Consumer Law that cannot lawfully be excluded.
10. Indemnity
You agree to indemnify and hold BuildCrate harmless against claims arising from your breach of these Terms, your content, or your unlawful use of the Service.
11. Termination
- You may terminate by cancelling your subscription at any time.
- We may terminate or suspend access immediately for breach of these Terms.
- On termination, sections 4,12 survive.
12. Changes to the Terms
We may amend these Terms. Material changes will be notified by email at least 14 days in advance. Continued use after the effective date constitutes acceptance.
13. Governing law & jurisdiction
These Terms are governed by the laws of Australia (state of Victoria). Disputes are subject to the exclusive jurisdiction of the courts of that jurisdiction.
